Picture to CAD 利用規約

この利用規約（以下「本規約」）は、合同会社ふるさとりんくす（以下「当社」）が提供するアプリ「Picture to CAD」（以下「本アプリ」）の利用条件を定めます。本アプリを利用すると、本規約に同意したものとみなします。
1. 本アプリでできること
本アプリは、写真・画像・PDF から、図面の下絵（DXF ファイル）を作ります。できあがるのは「下絵」であり、測量図・設計図などの正式な図面ではありません。
2. プラン
(1) 無料プラン：1 か月に 3 件まで、DXF を作成できます。数えるのは、DXF を作成した元の画像（PDF はページ）の数です。同じ画像・ページを設定を変えて作り直しても 1 件です。毎月 1 日に、枠は元に戻ります。
(2) Pro：DXF を無制限に作成できます。Google Play の定期購入です。料金は、Google Play の購入画面に表示されます。
(3) 送る操作そのものに、回数の制限はありません。
3. 定期購入
(1) 購読は、選んだ期間ごとに自動で更新され、料金が請求されます。
(2) 解約は、いつでも、Google Play の「定期購入」から行えます。解約しても、支払い済みの期間の終わりまでは Pro を利用できます。
(3) 返金は、Google Play の返金ポリシーに従います。当社は、日割りでの返金は行いません。
(4) 料金や内容を変更するときは、事前に知らせます。
4. 利用者の責任
(1) 読み込む写真・画像・PDF について、必要な権利や許可を持っていることは、利用者の責任です。
(2) 写真に写る人・施設・情報の取り扱い（肖像権、機密、立入りの許可など）は、利用者の責任です。
(3) できあがった下絵を、設計・施工・行政への提出などに使うときは、利用者が、現地や元の資料と照らして内容を確認し、必要な修正を行ってください。
5. 禁止事項
次のことを禁止します。(1) 法令または公序良俗に反する利用 (2) 他人の権利を侵害する写真・資料の読み込み (3) 本アプリの解析・改変・再配布、購読の確認の仕組みを回避する行為
6. 知的財産
本アプリに関する権利は、当社または権利を持つ第三者に属します。本アプリは、オープンソースソフトウェアを含みます。それらの権利表示と許諾条件は、アプリの「設定」→「オープンソースライセンス」に表示されます。利用者が作成した DXF や、読み込んだ画像・PDF の権利は、利用者に残ります。DXF は Autodesk, Inc. の商標です。本アプリは Autodesk, Inc. とは関係ありません。
7. 免責
(1) 本アプリは、できあがる下絵の、寸法・形・内容の正確さ、特定の目的への適合性を、保証しません。
(2) 当社は、法令で許される範囲で、本アプリの利用または利用できなかったことで利用者に生じた損害について、責任を負いません。ただし、当社に故意または重大な過失がある場合は、この限りではありません。
(3) 端末の機種・状態によって、処理に時間がかかったり、動かなかったりすることがあります。
8. サービスの変更・終了
当社は、必要があるときは、本アプリの内容を変更し、または提供を終了することがあります。
9. 規約の変更
当社は、本規約を変更することがあります。変更後に本アプリを使い続けたときは、変更に同意したものとみなします。
10. 準拠法・管轄
本規約は日本法に従います。本アプリに関して争いが生じたときは、津地方裁判所を第一審の専属的合意管轄裁判所とします。

Picture to CAD Terms of Use

These Terms of Use (the "Terms") set out the conditions for using the app "Picture to CAD" (the "App") provided by Furusato Links LLC ("we"). By using the App, you agree to these Terms.
1. What the App does
The App creates draft drawings (DXF files) from photos, images and PDFs. The result is a draft underlay, not an official drawing such as a survey or design drawing.
2. Plans
(1) Free plan: you can create up to 3 DXF files per month. What counts is the number of source images (pages for PDFs) a DXF was created from. Re-creating the same image or page with different settings counts once. The allowance resets on the 1st of every month.
(2) Pro: unlimited DXF files. It is a Google Play subscription. The price is shown on the Google Play purchase screen.
(3) Sending itself is not limited.
3. Subscription
(1) The subscription renews automatically for the period you choose, and you are charged each time.
(2) You can cancel at any time in Subscriptions in Google Play. After cancelling, you can keep using Pro until the end of the period you have paid for.
(3) Refunds follow Google Play's refund policy. We do not give pro-rated refunds.
(4) We will give notice before changing prices or contents.
4. Your responsibilities
(1) You are responsible for having the necessary rights and permissions for the photos, images and PDFs you load.
(2) You are responsible for how people, facilities and information shown in them are handled (portrait rights, confidentiality, permission to enter, and so on).
(3) When you use a draft for design, construction or submission to authorities, check it against the site and original materials and make the necessary corrections.
5. Prohibited acts
(1) Use that violates laws or public order; (2) loading photos or materials that infringe others' rights; (3) analysing, modifying or redistributing the App, or circumventing the subscription check.
6. Intellectual property
Rights in the App belong to us or to third parties who hold them. The App includes open-source software; their notices and licenses are shown in Settings → Open-source licenses. You keep the rights to the DXF files you create and to the images and PDFs you load. DXF is a trademark of Autodesk, Inc. The App is not affiliated with Autodesk, Inc.
7. Disclaimer
(1) We do not guarantee the accuracy of dimensions, shapes or contents of the drafts, or their fitness for a particular purpose.
(2) To the extent permitted by law, we are not liable for damages arising from the use of, or inability to use, the App. This does not apply where we acted intentionally or with gross negligence.
(3) Processing may be slow or may not work on some devices.
8. Changes to the service
We may change the App or end its provision when necessary.
9. Changes to the Terms
We may change these Terms. If you keep using the App after a change, you are deemed to agree to it.
10. Governing law
These Terms are governed by the laws of Japan. The Tsu District Court has exclusive jurisdiction in the first instance over disputes about the App.
